Jeffrey E. Poindexter

Biography:

Jeff Poindexter handles all aspects of civil litigation, arbitration and mediation and has worked on matters at both the trial and appellate court levels in both state and federal courts. Mr. Poindexter represents corporate and business clients of all sizes in litigation of a wide array of disputes, including contract, business, employment, trademark infringement and other commercial matters. Mr. Poindexter has substantial experience in representing owners and contractors in connection with small, medium and large construction projects, including negotiation and drafting of contracts and litigating, arbitrating and mediating construction law disputes.  He has been appointed by Massachusetts Governor Deval Patrick to the State’s Finance Advisory Board, which is a statutorily created board that reviews the Commonwealth’s direct and contingent debt requirements on a quarterly basis.  He currently is a member of the Board of Directors and Executive Committee of Springfield School Volunteers and also works with the Massachusetts Sections (Western and Eastern) of the National Machining and Tooling Association on a number of community and political initiatives.  Mr. Poindexter also served on the Board of Directors of the Springfield Boys’ Club and the Springfield Retirement Board for approximately ten years.

National manufacturer of products for the aerospace, petroleum, petro-chemical and heavy equipment industries in multi-jurisdictional commercial contract dispute pending in federal district court in Massachusetts, California and before the arbitration division of the International Chamber of Commerce.

Wholesale distributor of paper and packaging products in a trademark infringement action against competing company formed by former officer and shareholder

Private equity investors in multi-million dollar dispute with major Japanese company involving joint development and licensing agreements to develop and sell surveillance equipment utilizing millimeter wave technologies.

Wireless communications carriers in federal lawsuits against various municipalities seeking injunctive relief under the Telecommunications Act of 1996.

Company and majority shareholders against derivative and other claims by minority shareholder of limited liability company relating to alleged freeze-out and breach of fiduciary duties.

Hospital in several actions including an action against a construction manager and architect relating to alleged defective design and construction of a $100 million construction project.

Various colleges and a private school in connection with construction disputes involving claims and counterclaims with the general contractors, architects and subcontractors.

YMCA in a dispute with contractor, architect and subcontractors involving five separate litigations in court and arbitration relating to a multi-million dollar addition and renovation project.

HVAC installer in connection with dispute among owner, engineer, supplier and gas company relating to alleged acts and omissions with respect to the design, installation, supply and maintenance of heating system in multiunit condominium project.

City waterworks department in connection with multi-million dollar dispute with contractor relating to the construction of water facility.

General contractor in connection with dispute with city and subcontractor relating to alleged defective and deficient installation by subcontractor of HVAC system in city police station.
