Biography:
Mary J. Kennedy’s practice focuses on employment and medical malpractice litigation. Mary Jo has represented primarily employers in administrative proceedings before the Massachusetts Commission Against Discrimination and in state and federal courts. Mary Jo has successfully represented employment clients through trial in state court and at the MCAD. Mary Jo has advised employers on personnel issues, drafted personnel policies, and conducted a number of seminars on sexual harassment in the work place, employment discrimination in the hiring process, and the Massachusetts data breach laws and regulations. Mary Jo is the Coordinator of the Employment Law Practice Group.
Mary Jo’s medical malpractice practice includes the successful representation of physicians, dentists, and hospitals through trial in federal and state court. Mary Jo has also represented physicians before the Massachusetts Board of Registration in Medicine and nurses before the Massachusetts Board of Registration in Nursing.
Mary Jo has served on the Board of Directors of the Hampshire Regional YMCA from 2003 to 2009. Since 2000, Mary Jo has been on the Board of Directors of the Hampden County Bar Association, where she served as its President in 2003-2004. She is currently a regional delegate to the House of Delegates and a member of the Executive Management Board of the Massachusetts Bar Association.
Representative Experience:
Restaurant owner obtained dismissal of sexual harassment complaint after a public hearing at the Massachusetts Commission Against Discrimination.
Nursing home obtained a dismissal of a handicap discrimination complaint after a public hearing at the Massachusetts Commission Against Discrimination.
Representation of Assistant Superior Court Clerk who prevailed on her charge of sex discrimination at a public hearing at the Massachusetts Commission Against Discrimination and on her subsequent appeal to the Massachusetts Supreme Judicial Court.
Limited liability partnership obtained a jury verdict in its favor in a medical malpractice case arising from a surgical infection.
Emergency medicine physician corporation obtained a jury verdict in its favor in a wrongful death action alleging a failure to diagnose myocarditis.
Physician obtained a jury verdict in his favor in a wrongful death case alleging failure to diagnose a bleeding ulcer.
