J. Michael Scully

Biography:

Mike Scully is a member of the firm’s Litigation/ADR Department, Health Law Practice Group, and Schools, Colleges, and Universities Practice Group. He is engaged in all aspects of health law practice, with an emphasis on health care reform, regulatory compliance, privacy, finance, contracting, risk management, antitrust, and organizational governance. He also handles commercial and other civil litigation. Mike has handled numerous complex business litigation matters, including significant health care, antitrust, civil rights, ERISA, contract, and consumer protection cases, both in the federal and state courts. He has also written and lectured on various health law issues, including confidentiality and privacy, and end-of-life issues.

Mike is currently the chair of the Massachusetts Bar Association Health Law Section, and is active in community affairs. He is a volunteer with the Springfield School Volunteers reading program, and a local Troop of the Boy Scouts of America. He has also worked with the Community United Way of Pioneer Valley, Junior Achievement, and the March of Dimes Birth Defects Foundation.

After law school, Mike worked as a law clerk for the Justices of the Massachusetts Appeals Court in Boston, Massachusetts.

Represented numerous health care institutions and medical providers in a variety of litigation, regulatory, and business-related matters.

Represented health insurers in various litigation and regulatory compliance matters, including matters relating to the structure of benefit plans.

Successfully handled significant cases involving hospital and physician staffing, hospital billing and collection practices, and the confidentiality of medical information.

Successfully handled cases addressing the discovery process, and the rules of civil procedure.

Successfully handled large antitrust and consumer protection actions.

Significant litigation experience in representing banks, including cases related to lender liability and check fraud.

Significant experience in litigating matters related to land use and development.

Represented named parties, and class members, in various class-action lawsuits.

Represented both plaintiffs and defendants in personal injury cases.
