THREE NEW EEOC GUIDANCES

Recently, the Equal Employment Opportunity Commission issued three new guidances. The first is entitled "Questions and Answers About Epilepsy in the Workplace and the Americans with Disabilities Act." As the title suggests, this guidance explains how the Americans with Disabilities Act ("ADA") can apply to employees and applicants who have epilepsy. It can be found at www.eeoc.gov/facts/epilepsy.

The second guidance is entitled "How to Comply with the Americans with Disabilities Act: A Guide for Restaurants and Other Food Service Employers." This guidance contains information about the ADA, interaction of the ADA with the FDA Food Code, and an explanation of the ADA’s prohibition of disabilities discrimination. The guidance can be found at www.eeoc.gov/facts/restaurant_guide.

The third guidance is entitled "Questions & Answers About Persons with Intellectual Disabilities in the Workplace and the American with Disabilities Act." This guidance explains how the ADA can apply to employees and applicants who have intellectual disabilities, and can be found at www.eeoc.gov/facts/intellectual_disabilities.

Disability-related employment issues can be difficult to resolve. As with other employment matters, employers should consult with their legal counsel before taking any adverse employment action against an employee.
