Commonwealth Connector Extends Section 125 Plan Filing Deadline

Under the Massachusetts Health Care Reform Law (the “Act”), covered employers are required to maintain a Section 125 Plan that allows employees to pay for health insurance premiums using pre-tax dollars. The Act also requires covered employers to file their Section 125 Plans with the Commonwealth Connector, the agency that administers the law. (For more details on these requirements, please refer to our Spring 2007 Bulletin on the Act, available at www.bulkley.com.) On June 29, 2007, the Connector issued an administrative bulletin extending the time to file Section 125 Plans from July 1, 2007 until October 1, 2007. Further, the Connector provided notice that it will not accept plans for filing prior to September 1, 2007. The Connector may, however, request a covered employer to submit a copy of its proposed Section 125 Plan prior to October 1, 2007.
