The U.S. District Court recently allowed judgment on the pleadings in favor of Bulkley Richardson's client, C.A. Acquisition Newco LLC, the plaintiff, and denied defendant DHL Express (USA), Inc.'s motion for judgment on the pleadings as to all claims except for one equitable claim. The written decision is published as C.A. Acquisition Newco LLC v. DHL Express (USA), Inc., 795 F. Supp. 2d 140 (D. Mass. 2011).
Under the contract, the plaintiff provided software development and kiosk shipping services to the defendants at various locations throughout the United States. The Court awarded the plaintiff full contract damages based on the defendant's failure to pay termination fees after ceasing its United States operations. C.A.
