Recent Appellate Victory by BR&G Attorneys
On May 13, 2008, the Massachusetts Appeals Court affirmed a Berkshire Superior Court decision granting summary judgment on statute of limitations grounds in favor of the defendant, PricewaterhouseCoopers, LLP, represented by BR&G partners Sandy Dibble and Mike Scully. The Appeals Court ruled that the plaintiff knew or should have known of any harm he had suffered as a result of the defendant's alleged negligence more than three years before the plaintiff filed his lawsuit. PricewaterhouseCoopers denied that it had been negligent or that plaintiff had been harmed. The Appeals Court held that the three year statute of limitations for claims against accountants began to run regardless of whether the plaintiff had actual knowledge that the defendant's alleged conduct was legally negligent or knew the precise nature and extent of the harm he allegedly suffered. The decision in Petricca v PricewaterhouseCoopers is the fifth consecutive appellate victory obtained by BR&G lawyers in the last two years.
