Expert Testimony Questioned in Products Liability Suit Win

United States District Judge Michael A. Ponsor recently granted summary judgment for Sandoz, Inc. in a pharmaceutical products liability case in which BR&G's Jeff Poindexter served as local counsel for Sandoz, one of two defendants in the matter.

In Kerlinsky v. Sandoz, et al., the court found that the supplemental expert statement provided by the plaintiff, who alleged sustaining personal injury after taking medication manufactured by Sandoz, did not meet the requirements governing expert testimony and allowed the defendant's motion to strike the expert disclosure. Lacking expert testimony and ability to prove causation, the court also allowed the defendant's motion for summary judgment.
